Terms of Use — Delos Therapy LLC
Effective date: August 14, 2026
1. Acceptance of these terms
These Terms of Use (“Terms”) govern your use of the website of Delos Therapy LLC (“Delos Therapy,” “we,” “us,” or “our”), including delostherapy.com and its subdomains (together, the “Site”), our online booking system, and any products we offer for sale through the Site (together with the Site and online booking, the “Services”).
The Services do not include, and these Terms do not govern, in-person evaluation or treatment provided at our clinic locations, which is governed exclusively by a separate written consent, waiver, and assumption of risk agreement executed at intake (see Section 3). The Site also includes delosinstitute.com. These Terms do not govern the practitioner certification or training program itself, which is governed exclusively by the separate enrollment and training agreements executed at registration.
You must be at least 18 years old to use the Services or to book an appointment for yourself. If you are booking an appointment or completing intake on behalf of someone under 18, you represent that you are that person’s parent or legal guardian and have authority to do so.
By using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.
2. Our services
Delos Therapy operates myofascial and manual therapy clinics in the Chicago area, staffed by licensed therapists. This website describes our clinics, allows you to book appointments, and offers certain self-care products for sale, including the Delos Gumdrop. In-person evaluation and treatment provided at our clinics is not part of the “Services” governed by these Terms; it is governed by the separate agreement referenced in Section 3.
3. Not medical advice; in-person treatment
Our Services and the content on our site are not medical advice, diagnosis, or treatment, and are not a substitute for care from a physician or other qualified health provider. We do not diagnose medical conditions. Always seek the advice of your physician or another qualified provider with any questions about a medical condition, and consult your physician before beginning any new therapy, particularly if you are pregnant, injured, or have a medical condition. Never disregard or delay seeking professional medical advice because of something provided through our Services. If you think you may have a medical emergency, call your doctor or 911.
Your treatment relationship with Delos Therapy, including any consent, waiver, or limitation of liability applicable to in-person care, is governed exclusively by a separate written consent, waiver, and assumption of risk agreement that you will execute at intake, and not by these Terms.
4. Good Faith Estimates
If you are uninsured or choose not to use insurance for our services, you have the right to receive a Good Faith Estimate of expected charges before your first appointment and before purchasing a new package or course of care. Your Good Faith Estimate will describe the expected services and charges for the package or period of care you are purchasing, and will include, where applicable: an itemized list of expected services, the expected number of sessions, the provider furnishing them, and the total expected cost of the package. If a package or course of care extends beyond 12 months, we will provide a new Good Faith Estimate covering the following period rather than a single estimate for the full duration. This estimate is not a contract, does not obligate you to receive any service listed, and does not cover services outside the scope of the package you purchase, including additional sessions, add-on services, or products purchased separately.
You may request a Good Faith Estimate at any time, including before scheduling, by contacting us using the details in Section 20. If you schedule a package or session at least 3 business days in advance, we will provide your Good Faith Estimate no later than 1 business day after scheduling; if you schedule 10 or more business days in advance, we will provide it no later than 3 business days after scheduling. If you request an estimate before scheduling, we will provide it within 3 business days of your request.
If your actual charges for the scope described in your Good Faith Estimate are $400 or more above that estimate, you may be entitled to dispute the bill by initiating the patient-provider dispute resolution process within 120 days of the date of your bill. Information about this right, and how to start a dispute, is available at www.cms.gov/nosurprises or by calling 1-800-985-3059.
5. Communications; text messages
By using the Services, you consent to receive communications from us electronically, including by email, and agree that all agreements, notices, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.
By providing your phone number, you separately consent to receive appointment reminders and related account communications from Delos Therapy by text message (SMS) at that number. Message frequency varies based on your appointments. Message and data rates may apply. Consent to receive text messages is not a condition of purchasing any package or service. You may opt out of text messages at any time by replying STOP; for help, reply HELP, or contact us using the details in Section 20.
6. Booking, fees, and cancellations
Appointments may be booked through our third-party scheduling platform. The fees for our evaluation and treatment plans, along with deposit, cancellation, no-show, and expiration policies, are those disclosed to you at the time of booking or purchase. By booking, you agree to the fees and policies then in effect. We do not require deposits to book an appointment. We ask for at least 24 hours’ notice to cancel or reschedule an appointment. If you cancel or miss an appointment with less than 24 hours’ notice, the full session fee will be charged to your card on file or one session will be deducted from your prepaid package, at Delos Therapy’s discretion. All sales — including evaluations, sessions, and packages — are final and non-refundable. Prepaid packages expire one year from the date of purchase and are non-transferable.
7. Products and online orders
If you purchase products from us, the price, availability, shipping, and return terms are those presented at the time of your order. For products purchased directly from us through the Site or at a Delos Therapy clinic, the following return policy applies. Returns are accepted within 30 days of the delivery date for shipped orders, or within 30 days of the purchase date for in-clinic purchases, provided the product is unused and in its original packaging. Because our self-care tools are used directly on the skin, used products are not eligible for return or refund. To start a return, email info@delostherapy.com with your order number or receipt; we will confirm eligibility and provide return instructions. You are responsible for return shipping costs. Approved refunds are issued to the original payment method within 10 business days after we receive and inspect the return; original shipping charges are not refunded. If a product arrives damaged or defective, contact us within 30 days of delivery and we will replace it or refund it in full, including return shipping. We do not process direct exchanges; to change to a different color or model, return the unused product under this policy and place a new order. Products purchased through Amazon or any other third-party marketplace or retailer are governed by that marketplace’s or retailer’s own return policy. Our self-care products, including the Delos Gumdrop, are general self-care tools and are not medical devices. Use them only as directed and consult a qualified professional if you have any condition that could be affected by their use.
8. Intellectual property
The content on our Services including text, graphics, logos, and images and our trademarks, including Delos Therapy and Delos Body, are owned by Delos Therapy or its licensors and are protected by law. The Delos Gumdrop is protected by a patented design (U.S. Design Patent No. D841,829). We grant you a limited, personal, non-transferable license to view and use our Services for their intended purpose. You may not copy, reproduce, distribute, or create derivative works from our content or marks without our prior written permission.
9. Acceptable use
You agree to use the Services only for lawful purposes. You will not: misuse, disrupt, or attempt to gain unauthorized access to the Services or their underlying systems; use automated means, including bots or scrapers, to collect information from the Services; reverse engineer, decompile, or attempt to derive the source code of any part of the Services; use the Services to build or support a product or service that competes with the Services; frame, mirror, or incorporate any part of the Services into another website or application without our prior written permission; or use the Services in any way that infringes the rights of others or violates any law.
10. Feedback
If you send us feedback, suggestions, or ideas about the Services, you agree that we may use them for any purpose without compensation or attribution to you, and that any such feedback is not confidential.
11. Third-party services and links
Our Services rely on and may link to third-party services, including our scheduling and payment platform, payment processors, and online marketplaces, and to other third-party websites. Those third-party services are governed by their own terms, including our scheduling and payment platform’s own terms of service and payment processing terms. We are not responsible for the content, products, or practices of those third parties.
12. Use of the Services outside the United States
The Services are intended for use by individuals located in the United States. We make no representation that the Services are appropriate or available for use outside the United States. If you access the Services from outside the United States, you do so on your own initiative and are responsible for compliance with local laws.
13. Disclaimers
Except as expressly stated, the Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.
14. Limitation of liability
To the fullest extent permitted by law, Delos Therapy and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising out of or relating to your use of the Services (as defined in Section 1, which excludes in-person treatment). To the fullest extent permitted by law, the total liability of Delos Therapy and its owners, employees, and contractors for all claims arising out of or relating to the Services will not exceed the greater of (a) the total amount you paid to Delos Therapy for the Services in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred dollars ($100). Nothing in this Section limits, waives, or otherwise affects Delos Therapy’s obligations, or your rights, with respect to in-person treatment, which are governed exclusively by the separate consent agreement described in Section 3.
15. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
16. Entire agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Delos Therapy regarding the Services and supersede any prior agreements regarding the Services. They do not affect, and are separate from, the consent, waiver, and assumption of risk agreement governing in-person treatment described in Section 3.
17. No waiver; assignment
Our failure to enforce any provision of these Terms is not a waiver of our right to do so later. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, sale, or other business transaction.
18. Indemnification
You agree to indemnify and hold harmless Delos Therapy and its owners, employees, and contractors from any claims, damages, or expenses arising out of your misuse of the Services or your violation of these Terms.
19. Governing law; arbitration and dispute resolution
These Terms and any dispute arising out of or relating to the Services are governed by the laws of the State of Illinois, without regard to its conflict of laws rules.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved exclusively by binding arbitration administered by ADR Systems under its Commercial Arbitration Rules in effect at the time the arbitration demand is filed, rather than in court, except that either party may bring an individual action in small claims court for disputes within that court’s jurisdiction, and either party may seek injunctive relief in court to protect intellectual property rights. Delos Therapy will pay any ADR Systems filing or administrative fees in excess of what filing the same claim in small claims court would have cost. Arbitration will be conducted on an individual basis; you and Delos Therapy each waive any right to bring or participate in a class, collective, or representative action.
You may opt out of this arbitration agreement by sending written notice to Delos Therapy LLC, 219 W. Chicago Avenue, Chicago, IL 60654, or info@delostherapy.com within 30 days of the date you first accept these Terms. If you opt out, disputes will be resolved in the state or federal courts located in Cook County, Illinois, and you and Delos Therapy each consent to personal jurisdiction there.
This arbitration provision applies only to disputes concerning the Services as defined in Section 1. Disputes concerning in-person treatment are governed by the separate consent agreement described in Section 3, which contains its own dispute-resolution terms.
20. Notices; changes and contact
We may provide notices to you by email, through the Services, or by posting on the Site. We may update these Terms from time to time; the effective date above shows when they were last revised, and your continued use of the Services means you accept the updated Terms.
