Privacy Policy — Delos Therapy LLC

This Policy applies to Delos Therapy LLC, including our clinics, delostherapy.com, and the practitioner training programme operated as Delos Institute at delosinstitute.com.
1. Information we collect
Information you provide to us. This includes your name, email address, phone number, and mailing or billing address; appointment and booking details; information you choose to share for your care, such as your reason for visiting, relevant health history, and treatment preferences; purchase and order information; referral information; the contents of messages you send us; and, if you enquire about or enrol in a Delos Institute course, your professional licence type and practice details.
Information we collect automatically. When you use our Services, we may collect device and browser information, your IP address, the pages you view, and how you arrived at our site, using cookies and similar technologies (see Section 4).
Information from third parties. We may receive information from our booking and scheduling provider, our payment processors, and our analytics and advertising providers.
2. How we use your information
We use the information we collect to provide, schedule, and manage your appointments and our Services; process your payments and fulfill your product orders; communicate with you, including appointment reminders, responses to your questions, and where you have opted in — news and offers; operate, maintain, secure, and improve our Services and understand how they are used; and comply with our legal obligations and enforce our agreements.
3. Health-related information
Some of the information you share so that we can provide your care is health related. We treat this information as confidential and use it only to provide and support your care. We do not share your existing client records or treatment history with our advertising or analytics providers.
Our website advertising, including Meta and Google pixels and tags, targets ads using generic search terms and topics such as common symptom or condition terms to reach prospective clients; it does not use or receive your individual health records for this purpose. Because some of our landing pages are organized by topic (for example, back pain), visiting one of those pages may itself be recorded by our advertising providers as a page view, in the same way any page visit on our Site is recorded (see Section 4). We do not provide your name, contact information, or health history to advertisers in connection with this.
Delos Therapy provides myofascial and manual therapy services; we do not bill insurance on your behalf and do not assign medical diagnoses. If you choose to seek reimbursement from your own insurer, you do so directly with that insurer.
3A. Testimonials and reviews
With your separate, affirmative consent, we may share reviews or testimonials you provide about your experience with Delos Therapy in our marketing materials and on our website. Unless you specifically authorize us to include your name, photo, or other identifying details, we will remove or anonymize personal information, including any information that could identify you, before using your review. You may withdraw this consent at any time by contacting us using the details in Section 13; withdrawal will not affect reviews already published before we receive your request. This consent is separate from, and in addition to, the consents described elsewhere in this Policy and is not a condition of receiving treatment.
4. Cookies, analytics, and advertising
We use cookies and similar technologies to operate our site, remember your preferences, and understand site usage. We use analytics tools, including Google Analytics and Google Tag Manager, to measure how visitors interact with our site. We may also use advertising technologies, including pixels or tags from providers such as Google and Meta, to measure and deliver advertising. You can control cookies through your browser settings and can opt out of certain analytics and advertising through the tools those providers make available. Depending on your browser, a “Do Not Track” signal may also be available; we honor it but note it has no binding effect on most third-party providers.
Where required by applicable state law, we recognize and honor the Global Privacy Control (“GPC”) signal as a request to opt out of the sale or sharing of personal information and targeted advertising.
5. How we share information
We do not sell your personal information for money. We share information only as follows: Service providers, with companies that perform services for us, such as our booking and scheduling platform, payment processors, email and communications providers, website hosting, and analytics and advertising providers, who may use the information only to perform those services for us; Legal and safety, when we believe it is required by law, or necessary to protect the rights, safety, or property of Delos Therapy, our clients, or others; Business transfers, in connection with a merger, sale, or other business transaction; and With your consent, in any other case where you direct or permit us to.
Some uses of advertising technologies may be considered “sharing” or a “sale” of personal information under certain state privacy laws. If you reside in a state that provides this right, you may opt out as described in Section 9.
6. Payment information
Payments are processed by third-party payment processors. We do not store full payment card numbers on our own systems. Your payment information is handled under the processor’s own terms and security practices.
7. How long we keep information
We keep personal information for as long as needed to provide the Services, to satisfy the purposes described in this Policy, and to meet our legal, tax, and recordkeeping obligations. Specifically:
- Client care and treatment records (health history, treatment notes, session records): retained for at least 10 years after your last visit; if you were a minor at the time of your last visit, until you turn 23 or for 10 years after your last visit, whichever is longer.
- Payment and billing records: retained for 7 years from the date of the transaction, consistent with IRS recordkeeping guidance for supporting tax positions.
- Good Faith Estimates (Terms of Use, Section 4), if applicable: retained for at least 6 years, consistent with the No Surprises Act’s recordkeeping expectations.
- Website analytics and automatically collected device/browser data (Section 1): retained for up to 26 months, consistent with standard analytics-platform practice and data-minimization expectations under applicable state privacy laws.
- Marketing communications and consent records, including testimonial/review consent under Section 3A: retained for as long as we use the applicable content, plus 10 years after discontinuation or your withdrawal of consent.
- General inquiries and leads that do not result in a client relationship: retained for up to 24 months of inactivity, after which we delete or de-identify the information.
- Security incident records: retained for at least 5 years following resolution, to support the obligations described in Section 8.
After the applicable period, we take steps to delete or de-identify the information, except where a longer period is required by law, requested by you, or necessary to resolve a dispute or enforce our agreements.
8. Security incident notification
As a self-pay health-related business that is not a HIPAA covered entity, we comply with the FTC Health Breach Notification Rule (16 C.F.R. Part 318) and applicable state breach notification laws. In the event of a breach of security involving your unsecured personal information, we will notify you without unreasonable delay and, for breaches involving 500 or more individuals, will provide notice to the media and to the Federal Trade Commission, consistent with the timing, method, and content requirements of the Rule.
9. Your choices and rights
You may review or update the information you have given us by contacting us. You can unsubscribe from marketing emails at any time using the link in those emails. Depending on where you live, you may also have rights to access, correct, delete, or receive a copy of your personal information, and to opt out of certain sharing or targeted advertising, including through the Global Privacy Control described in Section 4. To exercise any of these rights, contact us using the details in Section 13. We will not discriminate against you for exercising them.
10. Security
We use reasonable administrative, technical, and physical safeguards designed to protect your information. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.
11. Children’s privacy
Our website and online Services are not directed to children, and we do not knowingly collect personal information online from children under 16. In-clinic services may be provided to minors only with a parent or guardian’s consent as described in our intake agreement. If you believe a child has provided us information online, please contact us and we will take appropriate steps to delete it.
12. Third-party sites
Our Services may link to third-party websites and services that we do not control, such as social media platforms and online marketplaces. This Policy does not apply to those sites, and we encourage you to review their privacy policies.
13. Changes and how to contact us
